GENERAL CONTRACTING CONDITIONS

1. PARTIES AND ACCEPTANCE OF THE GENERAL CONTRACTING CONDITIONS:

On the one hand, the provider of the products, Onlineology S.L. B01995679 (hereinafter also the “Provider”), with registered offices at C/Passeig Sant Joan 86 entresuelo Barcelona Spain, Customer Service e-mail: info@selectifofficial.com, being the owner of the website https://selectifofficial.com/ (hereinafter the “website”), and, on the other hand, the User – Client (hereinafter the “User”) who makes a purchase on the abovementioned website, being accountable for the veracity of the personal data submitted to the provider, agree to and are bound by the terms and conditions of this agreement.

The Parties BOTH ACCEPT this document, with the following implications to the User:

    1. The User declares to have read, understood and agreed with this agreement.

    1. The User is a person of legal age, with sufficient capacity to enter into agreements and be bound by the conditions of this agreement.

    1. The User assumes all the obligations set forth herein.

    1. The User has accepted these general purchasing conditions from the moment they purchase any of the products offered on the website.

This document can be printed and stored by the Users.

The present conditions will have an indefinite period of validity and will be applicable to all the agreements made through the website of the Provider. The Provider, with the objective of improving the products offered, reserves the right to unilaterally modify these General Contracting Conditions, without it affecting the goods or special offers that were acquired prior to the modification. In any case, these general conditions must be reviewed prior to purchasing the products. It is advisable that you keep a copy of this agreement with the purchased products.

Onlineology S.L. B01995679 is not responsible for any loss of data, files, or any damage that may result from the User’s failure to back up the data included in the purchased products, such as memory cards. Onlineology S.L. B01995679 is not responsible for any and all consequences that may result from improper use of the products that are sold on the web.

The civil liability of Onlineology S.L. B01995679 for the products supplied is limited to the amount of the same, and at the same time, the User waives to claim any liability to the Provider for any case related to the dissatisfaction of the products purchased on the website https://selectifofficial.com/, as well as any possible failures, slow access, or errors in accessing the web, which may include the loss of data or other information that may exist in the computer or network of the User accessing the web. Onlineology S.L. B01995679 is a company specialised in the remote sale of luxury and designer second hand bags and accessories, certified with renowned third-party authenticators, that sells its products over the Internet through its website and Instagram account @selectif_official. Onlineology S.L. B01995679 does not own any physical store for the sale of products.

2. OBJECT OF THE AGREEMENT:

2.1 Scope of application: The purpose of this agreement is to regulate the contractual purchase-sale relationship between the Provider and the User, which begins at the moment the User accepts by checking the corresponding box during the online contracting process, implying their acknowledgement and agreement to these purchasing conditions. These GCC will apply from the day the order is placed.

The contractual purchase-sale relationship includes the delivery of a specific product, in exchange for a specific price that is publicly exposed through the website. The product’s authenticity is certified with renowned third-party authenticators.

2.2 Territory of application: The virtual store of https://selectifofficial.com/ is active throughout Spain, Europe, Australia, Asia, South America, North America, the Middle East and Africa.

2.3 Legal capacity: To be able to place an order, you must be of legal age and have the required legal capacity to contract the services outlined in the Website.

2.4 Consent of the Client: The validation of an order through the web http://www.selectifofficial.com is executed by email, which also implies the automatic acceptance of the GCC. These conditions are available on the website http://www.selectifofficial.com or, if desired and requested, can be made available to you by email.

2.5. Modification of the General Contracting Conditions:  Onlineology S.L. B01995679 reserves the right to make changes and / or modifications to these GCC. We advise our clients to check and review them regularly. In the event that these changes or modifications were introduced after an order was placed, the conditions that will apply will be those of the date on which the order was placed.

3. INFORMATION PROVIDED ON THE WEB http://www.selectifofficial.com

3.1 Publication of prices: Exceptionally, the prices of the products shown on our website can be specified with errors and show a lower price than the actual corresponding price. In such event, and if we have already confirmed your order, we will contact you immediately in order to issue a new order confirmation that includes the correct price. In cases in which the actual corresponding price is higher, you may cancel your order and we will reimburse you for any amount that you have already paid.

3.2 Product information: The information contained in our advertising, brochures, and other written material, that can be either shown on our website or provided by our any of our agents and/or employees, all constitute an invitation to make a deal. This information does not constitute an offer to supply any product on our behalf.

The contents of http://www.selectifofficial.com are constantly renewed and updated in order to offer our clients the most complete and detailed information possible. As a result, it is possible that the contents may show, on exceptional occasions, provisional information in relation to some of the products. In the event that the information provided does not correspond to the characteristics of the product, the client can contact http://www.selectifofficial.com customer service to advise them on this discrepancy.

All contractual information on the website is displayed in English and communication with customers and Users, as well as the formalization of the contract, will be made in this language, although, if desired, the client may request to be addressed in another language, as long as there is an indication to such request prior to beginning the contracting procedure.

3.3 Availability of the product(s): There may be occasions when it could be impossible to supply all the products, which could be because they are either not in stock or available at the time of purchase. In these cases, we will contact you to give you a choice between the following options:

    1. choice of an alternative product, with similar characteristics of the product to be replaced;

    1. source the same product for you, if possible;

    1. cancel the order and receive a refund.

3.4 Right of Appeal:  Onlineology S.L. B01995679 reserves the right for this action (right of appeal), which is an action a customer can take if they are not satisfied with the quality of the product sold on http://www.selectifofficial.com. The quality and authenticity of all products sold on the website is guaranteed by our third-party authenticators (which in turn serves as a financial guarantee for each product we sell). In the event that a lack of quality is detected, the Customer Service of Onlineology S.L. B01995679 will evaluate the request. If a customer decides to take the product for evaluation to a third-party authentication service not partnering with Onlineology S.L. B01995679, it will be at their expense. If the result of the third-party authentication service does not coincide with the result issued by our authenticator, the customer will need to make a claim directly to our authenticator. We do not take responsibility for discrepant results as we already provide a reliable third-party authentication service for all of the products sold on http://www.selectifofficial.com. 

If the product differs in quality from what is advertised on the website and what has been communicated to the customer, the customer has a right to request an exchange or a refund within 14 days of receiving the order.

3.5 Orders 24 hours a day, every day of the year: The available admission hours for orders is twenty-four (24) hours, three hundred and sixty-five (365) days of the year, although orders placed after Two Thirty PM (14:30 PM) will not be processed that same day. Orders which have been received after the stated hour will be processed on the following business day in Barcelona. Orders received during the weekend will be processed early on the following Monday, or on the next business day.

3.6 Fraud: If any anomaly or fraud is suspected and detected, Onlineology S.L. B01995679 reserves the right to cancel the transaction for security reasons.

4. PURCHASE PROCEDURE:

In order to have access to the products offered by the Provider, the User must submit their personal information in the order section of the website. To do this, the User must freely and voluntarily provide the required personal data, which will be processed in accordance with the provisions of current regulations on personal data protection, Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, Spanish Organic Law 15/1999 of December 13 (LOPD) on the protection of personal data and Royal Decree 1720/2007, of development of the LOPD, which are further detailed in the Legal Notice and Privacy Policy of this website.

In accordance with the provisions set forth by Article 27 of Law 34/2002 for the Information Society and Electronic Commerce Services, the contracting procedure will be conducted through the following steps:

    1. The product is chosen by clicking on it, and it will be automatically added in the “Shopping Cart”.

    1. If there are more products to be added, the option “Continue Shopping” must be selected. If a product was mistakenly added or not wanted, you must click on the option to remove it from the shopping cart. In the shopping cart, you will see the items, the quantity, the price and the total amount for the products. Once all the products have been chosen, taxes, charges, and discounts will be calculated according to the payment and shipping data entered.

    1. Once the product (s) has/have been chosen, you must click on the final tab to place the order. When you click on this option, the purchase confirmation will appear (summary of the order placed, your data and chosen form of payment).

    1. The User will be requested to register in order to make the purchase (this registration is free), in which a data collection form must be completed (where you will also have to accept the Privacy Policy and the Legal Notice (and link both of them). Once the purchase has been made you will receive and email with the invoice and order number.

In any case, the Provider’s contracting platform will inform the User, once the contracting procedure is finished by means of an e-mail, which includes all the characteristics, price, transportations means, date of purchase, and estimated delivery of the purchased product(s).

If there is any type of error in the indicated address or in any other part of the order, you must immediately notify such error to the Customer Service e-mail address that will appear on the web, in order to proceed to its correction.

If you have any questions, you may contact our Customer Service through any of the methods provided on the website http://www.selectifofficial.com.

Onlineology S.L. B01995679 will provide Customer Service in a FREE manner, through our contact email info@selectifofficial.com. If you choose an alternative method of communication, the User is responsible for bearing all costs pertaining to such chosen method.

5. SHIPPING:

We want to ensure that your experience when shopping on the Site is as seamless and hassle-free as possible. We use DHL to ship most of our international orders. You can contact us at any time on info@selectifofficial.com if you have any questions regarding the status of your order or if you have general questions about our shipping costs, options and timings.

6. PRICES AND VALIDITY PERIOD OF THE OFFERS:

All prices displayed in the http://www.selectifofficial.com store do not include the VAT in force at the time of purchase. Taxes will be automatically added to the price at checkout. All the prices that appear on the website are valid, except those with typographical errors or related to products no longer in stock, and are expressed in Euro currency (€).

The payment made to the Provider will entail the issuance of an invoice in the name of the registered User. This invoice will be automatically sent to the e-mail address provided by the User, as well as a copy that is included in the delivery of the purchased product in printed form.

The client accepts and acknowledges that the economic valuation of some of the products may vary in real time. Such situations will always be previously communicated to the Users.

For the promotions of limited duration, the discount of the promotion will be applied as long as the order has been registered and concluded during the established promotion period.

The data recorded by the different payment methods constitute a proof of the date on which the financial transactions were carried out and will serve to determine if said order is or is not subject to promotion.

7. PAYMENT METHODS:

At the checkout page on the Site, you will be asked to complete a form with your billing information and choose a payment method.

Below, we detail the available payment methods:

7.1 Payment by credit or debit card: If you choose this option, you will be asked to fill in your card information and your credit or debit card will be debited with the cost of the goods you have ordered, plus the taxes (your Payment).

By paying using your credit or debit card you confirm that the card is yours and that there are sufficient funds or credit available to cover the charges. The User must have a valid credit or debit card, where all the digits of the card number must be specified in the corresponding form. The transaction is formally completed at the time of placing the order. We accept all credit and debit cards in which identity authentication is carried out.

The payment platform used is Redsys, which offers a secure environment payment system since it allows the encryption of the information transmitted during the transaction, ensuring its confidentiality.

7.2 Payment by wire transfer: If you choose wire transfer as your payment method, you will receive an email after you place the order with the information of our bank account and our WISE account details. You will have to email us the bank transfer slip once you have made the payment.

8. DELIVERY OF ORDERS:

8.1 Delivery Address: The delivery of orders will be made to the delivery address freely designated by the User. The Provider does not assume any responsibility when the delivery of the product does not occur because the User has provided data that is false, inaccurate, or incomplete, or when the delivery cannot be completed for reasons beyond the control of the shipping company assigned for that purpose, such as the absence of the recipient.

The delivery time of the order will be during regular business hours.

Notwithstanding the foregoing, the Provider has adopted the measures required of a diligent merchant so that the delivery can be made within the agreed time period, so no liability can be attributed to the Provider.

Onlineology S.L. B01995679 will put all the means at your disposal so that your order is delivered within the time period that is shown on our website, on the date of issuance of the order confirmation.

8.2 Terms of delivery: These terms correspond to those established in the file of each product.

8.3 Shipping confirmation: At the time of delivery of the order to our carrier, we will send a shipping confirmation to the email address that you have provided when placing the order. In the shipping confirmation, we will indicate the corresponding tracking number so you can track it through the website of our carrier.

8.4 Damage to delivery: Products are delivered in secure packaging. If at the time of delivery, the recipient detects, in a visible and clear form, without the need to manoeuvre the shipping package or those packaging natural to the product, that the product has defects attributed by damage caused by the carrier company, or if in the same manner, there is an error in the merchandise received, the User must detail this fact in the receipt that is provided and signalled by and of the carrier and immediately contact our Customer Service line or email postsales@selectifofficial.com. Such notifications must be executed within 24 hours after receipt, by which you will be able to be able to prompt the return of the affected product or products and proceed to their replacement by another in optimal conditions or, alternatively, receive a credit note for the price paid.

If a proof of delivery does not have any damage report, it is understood that the product has its packaging in perfect condition. Likewise, if a damage is detected in the product once the package is opened, and the packaging is in perfect condition, the client has 24 hours from reception to contact our customer Service or email postsales@selectifofficial.com. After 24 hours of delivery, no claims will be accepted for damage to the product.

8.5. Missing elements:

If there are any missing elements in your order- like a missing part of the product you have 24 hours upon receipt to contact customer service and notify them of the missing item. We will then ship them on our expense. If you contact us once the 24 hrs elapse, we can send the missing items at your expense.

9. RIGHT OF WITHDRAWAL:

Our products are preloved designer bags and accessories. We rely on our sellers to provide accurate information and photos on the website. We also authenticate each and every bag using renowned third-party authentication services, therefore there will be a certificate issued for each bag we sell unless we explicitly contact you and let you know that no certificate will be issued for that particular bag. We are not liable in the occasion where a seller sends us an incomplete package with missing elements. Our job as a business is to check the quality of the product, make sure it complies with the description and use renowned third-party authentication services to guarantee the authenticity of the product.

If you wish to return the product you can do so if the product is damaged or if it has qualitative differences in comparison to the product advertised on the website i.e., the color is different, or the product is in much worse condition than specified or we made a mistake and delivered the wrong product. Remember that these are preloved products and they may not be perfect to their entirety.

We do not approve refund requests from clients that have decided to use external third-party authentication services. If the reason for your refund is discrepancy in result from Authenticity tests you can contact us so we can provide another third-party authentication service. 

When you decide to shop from http://www.selectifofficial.com you choose us because you trust our quality control and the quality control of our Third- party authenticator.

That being said, of course we are always happy to answer all of your questions and will evaluate each refund request with care and dedication to provide our customers the best shopping experience possible.

9.1 Right of withdrawal: If a refund is approved (as per our Terms of Agreement) the User has 14 calendar days to return the product, which are counted from the date of receipt thereof (Article 71 of Law 3/2014, of March 27). If you are not satisfied with the product or any of the products of your order, the User may exercise his right of withdrawal by writing an email to postsales@selectifofficial.com (filling in the form attached below), indicating the order number (to obtain a refund of the amount of the product/s within the maximum period of fourteen (14) calendar days following the receipt of the returned order) together with your contact information. Unless the return is made for the plausible reasons mentioned in these terms, the provider reserves the right to waive the right of withdrawal. 

Once we approve the return, we will provide you with a return number and instructions for the return procedure. You must send it to us through the mail info@selectifofficial.com or by postal mail, always within the period of 14 calendar days upon receiving the orderAfter this period, you will not be able to request a refund

You must return the product with all the elements with which it was delivered, without any damage or wear marks of any kind, nor showing an inappropriate use of the good, nor should it be different in any way to the product originally sent, to the address that we have provided.

It is advisable to return the product in its original packaging. If this is not possible, the product will suffer a depreciation in its value. The Client will be responsible for the packaging and protection of the products that are sent as well as the expenses derived from its shipping.

As long as the products are returned within the said period of 14 calendar days, without any damage, wear and/or defects, and in compliance with the requirements established in this section, and always including the return number that we have provided, we will refund the total amount of the purchase.

Remember that in any case the product should include:

– Return number provided

– Order number

– Date of purchase and exercise of withdrawal

– Reasons for the return

– Information that you believe is necessary or of interest to process the return

9.2 Return by mistake in the order by Onlineology S.L. B01995679: When the product does not correspond to the placed order, due to an error that is attributable to the company, the User must communicate the company about this circumstance by mail as soon as possible, at info@selectifofficial.com; Onlineology S.L. will bear the cost of collecting the product(s) sent by mistake as well as those of the delivery of the order that was originally placed.

9.3 Verification of Returns: The verification and examination of the products to be returned will be borne by Onlineology S.L. B01995679 who, once in their facilities, will verify that they are received in compliance with all the requirements established in section 9.1. Failure to comply with these requirements may result in the cancellation of the guarantee or cause a decrease in the value of the product.

In case the product is missing any of its elements, the product will be returned to your home with a note indicating the missing content.

9.4 The right of withdrawal cannot be applied in the following cases:

    1. If the product is not presented in perfect condition.

    1. If the packaging of the product is not the original or it is not in perfect condition. The original packaging must protect the product so that it is received in perfect conditions, the use of seals and adhesive tapes applied directly on it is therefore forbidden.

    1. For products that are opened or with their tags removed, without being able to prove that they have not been used.

    1. For software applications that are directly downloaded through the portal.

    1. For personalized products or those that, due to hygienic reasons or other legally established exceptions, are not susceptible of this right.
    2. For discounted products or products that are included in a sales campaign
    3. For sourced products, namely a product petitioned by the customer to be purchased according to their specifications.

10. REIMBURSEMENTS:

10.1 Reimbursement for returns: In case of returns, the reimbursement of the amounts paid will be made through the same means of payment used in the purchase. Onlineology S.L. B01995679. will not refund the amount or make any return of merchandise until verification has been performed (for the reception, state of packaging and accessories of the product subject of the return).

10.2 Term of Reimbursement: the reimbursement will be made within a period of 15 business days from receipt and verification of the conditions of the product. The maximum period to make the established payment is 30 business days. To proceed with the reimbursement, you must provide us with the following information:

– return number

– invoice number and order

– IBAN + 20 digits of your bank account or last 4 digits of the credit card with which the payment was made

10.4 Onlineology S.L. declines the reimbursement if:

– the products are used or deteriorated, or their use has exceeded their nature.

– the products are missing any element.

    • You have used a third-party service to authenticate the product and it gives a result different than the one provided by our renowned third-party authenticators

11. APPLICABLE GUARANTEES AND AFTER-SALES SERVICES:

11.1 Guarantee:

We do quality and authenticity inspection for every product we receive, therefore the product we deliver to you will come with a third-party certificate of authenticity. Onlineology S.L. B01995679 will not be held liable for any defects that are beyond the scope of their own expertise.

    1. Unless proven otherwise, it will be understood that the products are in accordance with the contract, as long as they meet all the requirements that are expressed above, except when due to the circumstances of the case, some of them are not applicable to them:

    1. a) They are suitable for the uses to which products of the same type are ordinarily destined.

    1. c) They are suitable for any special use required by the client when he has notified Picola Tamarinda, S.L. at the time of signing the contract, provided that he has admitted that the product is suitable for this use.

    1. d) They present the usual quality and benefits of a product of the same type that the client can reasonably expect, taking into account the nature thereof and, where appropriate, the descriptions of the specific characteristics of the products made by Picola Tamarinda, S.L. and the certificate of authenticity issued by a third-party authenticator.

    1. e) Onlineology S.L. to the best of their knowledge checks the description of the details, technical characteristics, and photographs of the products which are in turn provided by the sellers.

    1. Liabilities shall not apply in the event that the User knows or has not been able to ignore the lack of conformity at the time of conclusion of the contract or that it has originated from the materials provided by said User.

11.2 Cases of cancellation of the guarantee: The guarantee is not covered for the following cases:

– Deterioration created by improper use of the product, inappropriate use, failure to comply with the instructions for use with regard to its usage and maintenance; or

–  Use of the product outside the private setting, for example, in intensive professional use; or

–  When the buyer sells the product to a third party.

12. ONLINE DISPUTE RESOLUTION

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online disputes between the USER and the PROVIDER, without the need to resort to the courts of justice, through the intervention of a third party, the Online Dispute Resolution Platform, which acts as an intermediary between the USER and PROVIDER. This organisation is neutral and will dialogue with both parties to reach an agreement, which may lead to suggest and / or impose a solution to the conflict. 12.1 NULL AND VOID CLAUSES:

If any clause included in these General Conditions is declared, either totally or partially, null or void, such nullity or voidness will only affect that sole provision or the part of it that is null or void, implying that the remaining General Conditions will subsist, having said provision, or the affected part of the same, considered as being excluded.

12. 2 APPLICABLE LAW AND JURISDICTION:

These conditions will be governed or interpreted in accordance with Spanish legislation in those matters that are not expressly established. In reference to the products and services that are subject to these Conditions, the Provider and the User agree to submit any dispute that may arise in such matters, to the Courts pertaining to the domicile of the Provider (if it is a legal entity) or the User (if it is a natural person).

In the event that the User has its domicile outside of Spain, the Provider and the User, expressly waive any other forum, submitting to the Courts of the city of Barcelona (Spain).

Returns, Exchanges and Refunds at Selectif

RETURN / EXCHANGE / REFUND ELIGIBILITY:

If you are unhappy with a product you purchased, you have the right to request a refund or an exchange within 14 calendar days of receiving the product (the moment you sign the acknowledgement of receipt). Please, send an email to info@selectifofficial.com stating your reasons for returning the product and we will get back to you within 48hs. Prior to issuing a refund or arranging for an exchange, the product must be returned to us (we will arrange the return shipping with DHL, but we do not cover the return shipping cost).

We do not accept returns/exchanges or issue any refunds on items that are not in the same condition as when the product was initially sent to the client. Items must be returned unworn, unused and in their original condition, with their original packaging and tags still attached (if applicable). Make sure that the item, within its original packaging, is packed securely with bubble wrap in a separate box that is secured with tape, to make sure that both the item and the packaging arrives to us safely with no damage. Please note that you will not be eligible for a refund if the product is damaged in places that were not mentioned in the description or if the product that is returned is not the one originally sent.

We do not accept returns/exchanges or issue any refunds/credit notes on sale items.

We do not accept returns/exchanges or issue any refunds/credit notes on products that have been customized or personalized to your specifications.

SHIPPING COSTS ASSOCIATED WITH RETURNS: 

Please note that if you decide to return an item, the initial shipping cost covered by Selectif will be deducted from your refund. Additionally, the return shipping cost is the responsibility of the customer. This means both the original shipping fee and the return shipping fee will be subtracted from the total refund amount.

Selectif will coordinate the return process through DHL to ensure secure and reliable handling; however, the cost of the return shipping label remains the customer’s responsibility.

PERSONAL SHOPPING SERVICE:

    • If you requested a product that is not available (not in stock when you placed your order) and our personal shopper is not able to find the product for you within 2 months, your deposit will be 100% refunded.

    • If you requested a product that is not available (not in stock when you placed your order) and one of our personal shoppers has sourced it for you, and the product is new from the store or in never used condition and matches the specifications you made on your request, we do not accept returns/exchanges or issue any refunds/credit notes. We invest time and resources to make sure you receive the product you desire and cannot cancel or refund an order that was personally sourced for you as per your exact specifications.

    • If you requested a product that is not available (not in stock when you placed your order) and our personal shopper has sourced it for you, and the product is new from the store or in never used condition but does not match all the specifications you made on your request, we will send you pictures and videos of the product. B01995679 (en adelante, el “Proveedor”), con domicilio social en Passeig Sant Joan 86 entresuelo 08009 Barcelona (España), correo de atención al cliente: info@selectifofficial.com, titular del sitio web https://selectifofficial.com (en adelante, el “sitio web”); y, por otra parte, el Usuario–Cliente (en adelante, el “Usuario”) que realiza una compra en dicho sitio web, siendo responsable de la veracidad de los datos personales facilitados al Proveedor.

Ambas partes aceptan este documento, con las siguientes implicaciones para el Usuario:

  • El Usuario declara haber leído, entendido y aceptado este acuerdo.
  • El Usuario es mayor de edad y tiene la capacidad legal suficiente para contratar.
  • El Usuario asume todas las obligaciones aquí recogidas.

No dispone de tienda física.

  1. OBJETO DEL CONTRATO

2.1 Alcance de aplicación

El presente contrato regula la relación de compraventa entre el Proveedor y el Usuario, que comienza cuando el Usuario acepta las condiciones marcando la casilla correspondiente durante el proceso de contratación online. Estas condiciones aplican desde el día en que se realiza el pedido.

La relación contractual incluye la entrega de un producto concreto a cambio de un precio determinado, públicamente expuesto en la web. La autenticidad del producto está certificada por autenticadores externos reconocidos.

2.2 Ámbito territorial

La tienda virtual de https://selectifofficial.com opera en España, Europa, Australia, Asia, América del Sur, América del Norte, Oriente Medio y África.

2.3 Capacidad legal

  1. PROCEDIMIENTO DE COMPRA

Para acceder a los productos ofrecidos por el Proveedor, el Usuario debe facilitar sus datos personales en la sección de pedido de la web. Estos datos se tratarán de conformidad con el Reglamento (UE) 2016/679 (GDPR), la Ley Orgánica 15/1999 y su normativa de desarrollo, según se detalla en el Aviso Legal y la Política de Privacidad del sitio.

El procedimiento de contratación seguirá estos pasos:

  • Seleccionar el producto, que se añadirá automáticamente al Carrito.
  • Si desea añadir más productos, elija “Seguir comprando”. Para eliminar un producto, use la opción correspondiente en el Carrito. Allí verá artículos, cantidad, precio e importe total. Los impuestos, gastos y descuentos se calcularán según los datos de pago y envío introducidos.

  1. MÉTODOS DE PAGO

7.1 Tarjeta de crédito o débito

Si elige esta opción, se le solicitarán los datos de la tarjeta y se cargará el coste de los bienes más impuestos. Al pagar, confirma que la tarjeta es suya y que dispone de fondos suficientes. La transacción se completa al realizar el pedido. Se aceptan tarjetas con autenticación de identidad. La pasarela de pago es Redsys, que cifra la información transmitida garantizando su confidencialidad.

7.2 Transferencia bancaria

Si elige transferencia, recibirá por email los datos de nuestra cuenta bancaria y cuenta WISE tras realizar el pedido. Deberá enviarnos el comprobante de la transferencia por email una vez efectuado el pago.

  1. ENTREGA DE PEDIDOS

8.1 Dirección de entrega

La entrega se realizará en la dirección indicada por el Usuario. El Proveedor no se hace responsable si la entrega no puede efectuarse por datos falsos, inexactos o incompletos, o por causas ajenas a la empresa de transporte (como ausencia del destinatario). El horario de entrega será en horas laborables.

Onlineology S.L. B01995679 adoptará medidas diligentes para que la entrega se realice en el plazo acordado, sin que pueda atribuirse responsabilidad por retrasos ajenos a su control.

8.2 Plazos de entrega

Los plazos de entrega serán los indicados en la ficha de cada producto.

8.3 Confirmación de envío

Al entregar el pedido al transportista, enviaremos una confirmación de envío al email facilitado, indicando el número de seguimiento para consultarlo en la web del transportista.

8.4 Daños en la entrega

Los productos se entregan en embalaje seguro. Si en el momento de la entrega detecta daños visibles en el paquete o errores en la mercancía, indíquelo en el albarán del transportista y contacte de inmediato (dentro de las 24 horas) con postsales@selectifofficial.com para gestionar la devolución y sustitución o, en su caso, un abono.

Si el albarán no refleja daños, se entiende que el embalaje estaba en perfecto estado. Si detecta daños tras abrir el paquete, dispone de 24 horas desde la recepción para comunicarlo a atención al cliente. Pasado dicho plazo, no se aceptarán reclamaciones por daños.

8.5 Falta de elementos

Si falta algún elemento del pedido, dispone de 24 horas desde la recepción para comunicarlo a atención al cliente. En ese caso enviaremos los elementos faltantes a nuestro cargo. Transcurrido dicho plazo, podremos enviarlos repercutiendo el coste.

  1. DERECHO DE DESISTIMIENTO

Nuestros productos son bolsos y accesorios de diseñador de segunda mano (preloved). Confiamos en nuestros vendedores para proporcionar información y fotografías precisas en la web. Además, autenticamos cada bolso utilizando servicios de autentificación de terceros reconocidos; por lo tanto, se emite un certificado para cada bolso que vendemos, a menos que nos pongamos en contacto con usted y le informemos expresamente de que no se emitirá certificado para ese bolso en particular. No nos hacemos responsables en el caso de que un vendedor nos envíe un paquete incompleto con elementos faltantes. Nuestro trabajo como empresa es revisar la calidad del producto, asegurarnos de que cumpla con la descripción y utilizar servicios de autentificación de terceros reconocidos para garantizar la autenticidad del producto.

Si desea devolver el producto, puede hacerlo si este llega dañado o presenta diferencias cualitativas respecto al producto anunciado en la web (por ejemplo, si el color es distinto, el estado es mucho peor al especificado o si cometimos un error enviándole un producto equivocado). 9.1 Derecho de desistimiento:

Si se aprueba un reembolso (según nuestros Términos de Contratación), el Usuario dispone de 14 días naturales para devolver el producto, contados desde la fecha de recepción del mismo (Artículo 71 de la Ley 3/2014, de 27 de marzo). Si no está satisfecho con el producto o con alguno de los productos de su pedido, el Usuario podrá ejercer su derecho de desistimiento enviando un correo electrónico a postsales@selectifofficial.com (rellenando el formulario adjunto), indicando el número de pedido, sus datos de contacto y solicitando el reembolso. A menos que la devolución se realice por las causas previstas en estos términos, el proveedor se reserva el derecho de denegar el derecho de desistimiento.

Una vez aprobada la devolución, le facilitaremos un número de devolución y las instrucciones para el procedimiento. Debe enviarnos el producto por correo electrónico a info@selectifofficial.com o por correo postal, siempre dentro del plazo de 14 días naturales tras la recepción del pedido. Después de este plazo, no podrá solicitar un reembolso.

Debe devolver el producto con todos los elementos con los que fue entregado, sin daños ni señales de uso indebido, ni debe diferir en ningún aspecto del producto enviado originalmente, a la dirección que le proporcionemos.

Se recomienda devolver el producto en su embalaje original. Si esto no fuera posible, el producto puede sufrir una depreciación en su valor. El Cliente será responsable del embalaje y protección de los productos enviados, así como de los gastos derivados del envío.

Siempre que los productos se devuelvan dentro del plazo de 14 días naturales, sin daños, desgaste y cumpliendo los requisitos establecidos, y siempre incluyendo el número de devolución proporcionado, reembolsaremos el importe total de la compra.

Cuando el producto no corresponda al pedido realizado por un error atribuible a la empresa, el Usuario deberá comunicarlo lo antes posible al correo info@selectifofficial.com. Onlineology S.L. asumirá el coste de recogida del producto enviado por error así como el de la entrega del pedido original.

9.3 Verificación de devoluciones:

La verificación y examen de los productos a devolver correrán a cargo de Onlineology S.L. B01995679 que, una vez en sus instalaciones, comprobará que cumplen con todos los requisitos establecidos en la sección 9.1. El incumplimiento de estos requisitos puede resultar en la cancelación de la garantía o en una disminución del valor del producto.

En caso de que falte algún elemento en el producto, este será devuelto a su domicilio con una nota indicando el contenido faltante.

9.4 El derecho de desistimiento no podrá aplicarse en los siguientes casos:

– Si el producto no se presenta en perfecto estado.

– Si el    embalaje del producto no es el original o no está en perfecto estado. El embalaje original debe proteger el producto, por lo que no se permite el uso de precintos o cintas adhesivas aplicadas directamente sobre él.

– Para productos abiertos o con etiquetas retiradas, sin poder demostrar que no han sido usados.

– Para productos personalizados o aquellos que, por razones de higiene u otras excepciones legales, no sean susceptibles de desistimiento.

  1. REEMBOLSOS

10.1 Reembolso por devoluciones

En caso de devolución, el reembolso se realizará por el mismo medio de pago utilizado en la compra. No se realizará el abono hasta verificar recepción, estado del embalaje y accesorios del producto.

10.2 Plazo de reembolso

El reembolso se efectuará en un plazo de 15 días hábiles desde la verificación del producto (máximo 30 días). Para proceder, se deberá facilitar: número de devolución; número de factura y pedido; IBAN y 20 dígitos de la cuenta bancaria o los últimos 4 dígitos de la tarjeta con la que se pagó.

10.3 Supuestos de denegación

  • Productos usados o deteriorados, o cuyo uso exceda su naturaleza.
  • Productos incompletos o con elementos faltantes.
  • Se haya utilizado un servicio externo independiente de autenticación con resultado distinto al de nuestros autenticadores reconocidos.
  1. GARANTÍAS Y SERVICIO POSVENTA

11.1 Garantía

Realizamos inspección de calidad y autenticidad en cada producto recibido; por ello, se entrega con certificado de autenticidad de un tercero reconocido. Onlineology S.L. B01995679 no será responsable de defectos que excedan el ámbito de su pericia.

Salvo prueba en contrario, se entenderá que los productos son conformes al contrato si: (a) son aptos para los usos ordinarios de productos del mismo tipo; (c) son aptos para cualquier uso especial solicitado por el cliente y admitido por Onlineology S.L. (d) presentan la calidad y prestaciones habituales que el cliente puede razonablemente esperar, atendiendo a la naturaleza del producto, a las descripciones y al certificado de autenticidad; (e) la descripción, características técnicas y fotografías se verifican a nuestro leal saber y entender con la información proporcionada por los vendedores.

No habrá responsabilidad cuando el Usuario conociera o no pudiera razonablemente ignorar la falta de conformidad al concluir el contrato, o cuando esta se origine en materiales proporcionados por el Usuario.

11.2 Exclusiones de garantía

  • Deterioro por uso impropio o incumplimiento de las instrucciones de uso y mantenimiento.
  • Uso fuera del ámbito privado (p. ej., uso profesional intensivo).
  • Cuando el comprador revende el producto a un tercero.
  1. RESOLUCIÓN DE LITIGIOS EN LÍNEA

De conformidad con el art. 14.1 del Reglamento (UE) 524/2013, la Comisión Europea ofrece una plataforma de resolución de litigios en línea (ODR), accesible en http://ec.europa.eu/consumers/odr/.

12.1 Nulidad y anulabilidad

Si alguna cláusula de estas Condiciones Generales fuese declarada, total o parcialmente, nula o anulable, dicha nulidad afectará solo a esa disposición, subsistiendo el resto de cláusulas.

12.2 Ley aplicable y jurisdicción

Estas condiciones se regirán e interpretarán conforme a la legislación española. En cuanto a los productos y servicios sujetos a estas Condiciones, el Proveedor y el Usuario se someten a los Juzgados y Tribunales del domicilio del Proveedor (si el Usuario es persona jurídica) o del Usuario (si es persona física). Si el Usuario tuviese su domicilio fuera de España, ambas partes se someten a los Juzgados y Tribunales de Barcelona (España).

DEVOLUCIONES, CAMBIOS Y REEMBOLSOS EN SELECTIF

Elegibilidad (Productos en stock)

Si no está satisfecho con un producto adquirido, puede solicitar devolución o cambio dentro de los 14 días naturales desde la recepción (momento de la firma del acuse). Escriba a info@selectifofficial.com indicando los motivos. Antes de emitir reembolso o gestionar cambio, el producto debe retornarse (coordinamos la recogida con DHL; el coste de la etiqueta de devolución corre a cargo del cliente).

No se aceptan devoluciones/cambios ni reembolsos en artículos que no estén en el mismo estado que cuando se enviaron: deben devolverse sin usar, en su estado y embalaje originales, con etiquetas (si aplica). Embale el artículo dentro de su embalaje original y en una caja adicional con protección para evitar daños. No será elegible el reembolso si el producto llega con daños no descritos o si no corresponde al artículo enviado.

No se aceptan devoluciones/cambios ni se emiten reembolsos/vales en artículos en oferta ni en productos personalizados.

COSTES DE ENVÍO ASOCIADOS A DEVOLUCIONES

Si decide devolver un artículo, el coste de envío inicial cubierto por Selectif se deducirá del reembolso. Además, el coste del envío de vuelta es responsabilidad del cliente. Por tanto, se descontarán del importe total tanto el envío inicial como el de retorno.

Selectif coordinará el proceso de devolución a través de DHL para un manejo seguro y fiable; no obstante, el coste de la etiqueta de devolución seguirá siendo responsabilidad del cliente.

SERVICIO DE PERSONAL SHOPPING

Si solicitó un producto no disponible y nuestro personal shopper no lo encuentra en 2 meses, el depósito se reembolsa al 100%.

Si el personal shopper lo encuentra y el producto es nuevo de tienda o nunca usado y coincide con sus especificaciones, no se aceptan devoluciones/cambios ni se emiten reembolsos/vales.

Si el personal shopper lo encuentra, el producto es nuevo o nunca usado pero no coincide con todas sus especificaciones, le enviaremos fotos y vídeos. Si tras recibirlos confirma la compra y paga el total, no se aceptan devoluciones. Si no confirma la compra, emitiremos un vale por el importe del depósito.

Si el personal shopper lo encuentra y el producto es pre-loved y coincide con sus especificaciones, le enviaremos fotos y vídeos al recibirlo. Si confirma y paga, no se aceptan devoluciones. Si no confirma, emitiremos un vale por el importe del depósito.

Excepciones de reembolso

No se emiten reembolsos/vales sobre depósitos abonados como anticipo de productos en stock.

No se emiten reembolsos basados en autenticaciones independientes del cliente. Si tiene dudas sobre la autenticidad, para ser elegible deberá devolver el producto en 14 días naturales desde la recepción para reautenticación. Podemos gestionar autenticadores externos a su cargo. Si resulta auténtico, se le devolverá con el certificado. Si, de forma improbable, resultara no auténtico, se reembolsará íntegramente. Fuera del plazo de 14 días, estudiaremos el caso y decidiremos si procede reautenticación, para lo que deberá aportar evidencias (p. ej., certificado de un autenticador reconocido).

Cancelación de pedido

Si compró un artículo en stock y cambió de opinión, contacte con Atención al Cliente dentro de las 48 horas desde la compra para proceder a su cancelación.

Peticiones especiales

Si tiene solicitudes especiales al realizar un pedido, indíquelas en el apartado de comentarios del pedido.

Plazos de reembolso/cambio

  • Cambio por artículo en stock: se enviará en cuanto recibamos y verifiquemos el artículo devuelto.
  • Producto no disponible: lo buscaremos en aproximadamente 3–4 semanas desde la verificación de la devolución.
  • Reembolso: se abonará al método de pago original en unas 2 semanas desde la verificación; la reflejan en cuenta en 1–2 semanas adicionales según el medio de pago. No respondemos por fluctuaciones de divisa ni comisiones bancarias.

ENVÍOS

El envío es GRATUITO en TODOS los pedidos INTERNACIONALES. Trabajamos para que los pedidos se envíen a tiempo.

Productos en stock: envío en 48 horas desde la recepción del pago (no se envían sábados, domingos ni festivos).

Productos en consignación: tardan más, al estar con el propietario original. Por favor considerar 2–3 semanas para el envío, ya que puede llevar 1–3 semanas recibirlos y autenticarlos.

Productos que han sido obtenidos mediante personal shopper tardaráN mas tiempo en ser enviados. El proceso de sourcing tarda aprox. 4 semanas desde el depósito. Una vez llegue a nuestras oficinas, el cliente paga el saldo y se envía en 48 horas.

Selectif trabaja con DHL para garantizar la entrega puntual y de calidad de sus pedidos. Ofrecemos los siguientes servicios de envío:

  • Envío exprés
  • Opción de elegir un punto de recogida DHL como dirección de entrega en lugar de su domicilio
  • Seguimiento en tiempo real de su pedido
  • Atención al cliente 24/7
  • Devoluciones con opción de recogida en domicilio o entrega en un punto de recogida DHL
  • SMS con el número de seguimiento en cuanto el pedido sea enviado
